In August 1995, Dr. Alan Schwartz filed suit against Kennesaw State College alleging anti-Semitism for non-renewal of his employment contract for the 1995-1996 academic year in the Department of Communication. The judge dismissed all claims on September 26, 1997.

A related case transpiring at the same time, Kaspers vs. Board of Regents, involved allegations of breach of contract and retaliation against the plaintiff, Candace Kaspers, when she was removed from her position of Chair of the Department of Communications after communicating her concerns of the effect on the faculty that the non-renewal of two Jewish faculty members (i.e. Dr. Alan Schwartz and Ms. Bari Levingston) would have.
